Аннотация: Досліджено сучасні методологічні підходи до суті ринку сільськогосподарських земель. Зазначено функції ринку землі й основні умови ефективного його функціонування в агарному секторі економіки України. Висвітлено особливості формування інфраструктурного забезпечення ринку землі у європейських країнах. Вивчено зарубіжний досвід діяльності земельних банків. Розглянуто першорядні завдання, які вирішуються за допомогою земельних банків в умовах цивілізованого ринку землі у країнах ЄС. Встановлено, що одним із напрямів одержання кредитів для сільськогосподарських товаровиробників може бути застава землі, механізм якої працюватиме лише в умовах запровадження ринку сільськогосподарських земель та створення спеціальної фінансової установи – земельного банку.
Introduction. The adherents of farm land market point out that it must function, as the private ownership of land encourages its effective use. The opponents of farm land market formation state that at the present state of development the inclusion of land in the economic turnover is inexpedient, since this can entail a number of negative consequences. The formation of the market of land resources is of the greatest interest to international corporations and financial organizations as well as to monopoly-and-financial groups which will buy up lands under favorable for them conditions, artificially sustaining low land prices. The land market will deprive of the property right to land those who work on it, and the setting up of mortgage banks will cause land plot losses by peasants. Results. Domestic economic publications present different views on the interpretation of the essence of farm land market. From the legal point of view it is a totality of social relations which are regulated by the provisions of active legislation in the course of land redistribution by governmental and local authorities. The concept of land market also includes the system of legal and economic relations concerning the ownership, use and disposition of land plots. Publications most often interpret land market as a purchas-sale process which is the implementation of the mechanism of land supply and demand interaction. The idea of land market being a medium of land redistribution among its owners by economic methods on the basis of competitive supply and demand, it is worth of paying attention to. This article describes the current methodological approaches to the essence of the market for agricultural land. We noted features of the land market and its main conditions for effective functioning in the agrarian sector of Ukraine. The peculiarities of the formation of a land market infrastructure provision in developed countries. Study of foreign experience of land banks. The study considered the primary problem to be solved by means of land bank s in terms of civilized land market in foreign countries. We found that one of the ways of obtaining loans for agricultural producers can pledge land mechanism which will work only in a market introduction of agricultural land and the creation of a special financial institution – the land bank. Conclusions. The development of farm land market in Ukraine is taking place together with the creation of the competitive environment in the national economy and building up of the specialized infrastructure. The effective functioning of this market provides for the control on the part of the state which must regulate land redistribution, determine the size of private landholdings and control their intended use. The land market regulation is that with the aid of market mechanisms and government control the land would pass from ineffective producers to more effective ones. The farm land market functioning in economic, natural and legal aspects requires the adherence to a number of principles which must be the basis, central idea and foundation of the market land system. The fundamental principles of farm land market forming and its stable functioning should be the government regulation, freedom in the activities of economic management entities, self-financing, economic responsibility for management results and competition on the land market. Although the Ukrainian authorities are still working on the final version of the land market bill. Lawmakers are currently discussing many limitations concerning land ownership, lease rights, preemptive rights and size of land plots to own. Below we provide a brief analysis of how land reform was carried out in peer countries and compare Ukrainian lawmakers’ initiatives.
